Peter Folger is a partner in our Labor & Employment Practice Group. In the area of traditional labor law, Peter’s practice has included leading collective bargaining negotiations for employers and representing employers in court, arbitration and National Labor Relations Board proceedings. He also provides pre-litigation and transactional-related guidance and counseling to employers regarding federal, state and local regulations. In addition to his employment and labor practice, Peter assists clients in matters concerning trust administration and litigation. He also has particular expertise in serving the legal needs of independent schools.

Peter received his law degree (cum laude) from the University of San Francisco Law School in 1973 and his undergraduate degree in History from Stanford University in 1967. During law school, he served as extern law clerk to Associate Justice Raymond L. Sullivan of the California Supreme Court.

Between 1967 and 1970, Peter served in the United States Marine Corps. In 1978, Peter co-founded Folger & Levin. He has been a member of the California Bar since 1973.

Peter is active in a number of community organizations and, in particular, has assisted educational institutions. Peter has been a member of Santa Catalina School’s Board of Trustees since 1985, serving as its Chair from 1992 to 2007. Since 1983, he has been a member of the Board of Counselors at the University of San Francisco School of Law, and became its Chair in 2002. He previously served as Chair of the Boards of Trustees of Katherine Delmar Burke School and Town School for Boys, as well as serving as a member for seven years of San Francisco University High School’s Board of Trustees.

Our practice embraces employment litigation, preventive counseling, traditional labor law, and employment-related business issues. As litigators, our attorneys have successfully defended Title VII, wage and hour, ERISA and WARN Act class actions as well as discrimination lawsuits, wrongful termination claims, and claims involving the use of intellectual property and trade secrets by former employees. We have also handled hundreds of charges filed with state, federal and municipal agencies. Recognizing that our clients are often best served by avoiding litigation altogether, we advise clients on a preventive basis, providing strategic counseling on employment issues and laws, reviewing personnel policies and employee handbooks, conducting seminars and legal audits, planning for reductions in force and layoffs (including WARN compliance), and advising clients on the enforceability of non-competition and nondisclosure agreements.     While nonprofit and charitable organizations face many of the same legal issues as for-profit organizations, the many state and federal legal requirements that are unique to nonprofits make experience with nonprofits essential to effective representation. Attorneys from all our practice groups collaborate to respond to the needs of our nonprofit clients, and, as a result, we are able to counsel our nonprofit clients efficiently and effectively. Folger Levin’s attorneys have extensive experience representing nonprofit organizations on a wide range of issues, including formation, corporate governance, taxation, real estate, financings (include exempt bond issuances), intellectual property, and employment matters. We have also represented nonprofit organizations in litigation before state and federal courts and administrative agencies in matters involving bequests and trust distributions, fiduciary duties, wage and hour, wrongful termination and employee benefit claims, and contract disputes.
